Maritime Management, Organization and Liability
The research project aims to identify and analyze organizational challenges and related liability questions in the maritime sector caused by current challenges such as sustainability requirements and automation.
The research project Maritime Management, Organization and Liability Law (2015-2021) is carried out by CEPRI members in regular contact with maritime industry stakeholders and together with international partners, including the Centre for Maritime Law at the National University of Singapore (NUS) .
Today’s shipping industry is organized in large, complex enterprises that operate globally. The efficient running of the shipping companies requires professional management and organization. Whereas ownership and proficiency used to be embedded in the same person (the owner), the management of today’s shipping company is often outsourced to one or more professional actors. In itself, this splitting up of the management at the organizational level raises many questions concerning the distribution of risk and liability and outsourcing of various functions must be expected to increase as automated ships are introduced. In addition, the amount of regulation in the maritime area has massively increased over the years, just as a new tendency is seen in certain national legal systems to introduce legislation with extraterritorial effect, often concerning the role played by shipping companies as enforcers of sustainability requirements. As a result, it becomes a managerial task for the shipping companies to ensure the compliance also with this sort of legislation, taking into account the the increasing role played by classification societies as private standard setters in various respects.
In this project, we deal with the topics described above and other topics falling within the general theme of maritime management, organization and liability.
The project analyses the general concept of extraterritorial effect and conducts case studies into the example of modern slavery in shipping, exploring inter alia various contract clauses as a private governance tool (Contact person: Maxim Usynin).
The project focuses on the challenges in managing ships as waste within the existing regulatory framework. It also addresses various environmental aspects of shipping from a managerial perspective (Contact person: Carola Glinski).
The project focuses on the liability implications of the the introduction of unmanned and automated ships, examining both contractual and tort law liability questions in the interplay with existing regulatory frameworks (Contact person: Vibe Ulfbeck)
